Agent Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the ValuQ platform as a licensed estate agent. By creating an account and subscribing to a plan, you agree to be bound by these Terms.
Please read them carefully. If you do not agree, do not use the Platform.
1. Eligibility and verification
You must be a licensed estate agent in the United Kingdom to use ValuQ. Your agency must be:
- •Registered with the appropriate regulatory body (e.g., NAEA, RICS)
- •Compliant with Consumer Rights Act 2015 and estate agency regulations
- •In good standing with no suspended licenses or active enforcement actions
- •Able to provide proof of valid insurance and professional indemnity
ValuQ may verify your credentials at any time. We reserve the right to decline or terminate agents who fail verification.
2. Account setup and coverage zones
You must complete account setup with accurate agency information: name, registered address, contact details, and compliance details.
You will define your coverage zones (postcode sectors you serve). You can only receive leads in those zones.
You are responsible for ensuring your coverage zones are accurate. If a lead arrives outside your area, contact support immediately.
Misrepresenting your coverage area to access leads you cannot serve violates these Terms.
3. Subscription terms and billing
Subscription plans:
- •Starter: £49/month (10 leads, 1 user, 5 zones)
- •Growth: £149/month (unlimited leads, 3 users, 20 zones)
- •Pro: £299/month (unlimited leads, unlimited users, unlimited zones, API)
All plans include a 14-day free trial. No credit card required to start.
After the trial, billing is monthly. You will be charged on the same date each month.
You can cancel anytime. Cancellation takes effect at the end of your current billing cycle.
4. Payment and refunds
You authorize ValuQ to charge your card on file monthly. Failure to pay may result in suspension of your account.
All payments are non-refundable unless required by law (e.g., if you cancel within 14 days of a new subscription).
If payment fails, we will retry up to 3 times. If unsuccessful, your account will be suspended until payment is received.
5. Lead terms and response requirements
When you receive a lead:
- ✓You have 48 hours to review the property brief
- ✓You must submit a valuation within 48 hours of receipt
- ✓Your valuation must be in good faith and professionally sound
- ✓You cannot contact the seller before they choose to connect with you
If you do not respond within 48 hours, the lead is marked incomplete. Consistent non-response may affect your ranking and lead allocation.
You may not:
- ✗Submit a blank or incomplete valuation
- ✗Copy another agent's valuation
- ✗Submit inflated valuations to "win" the lead
- ✗Contact the seller before they initiate contact
- ✗Contact other agents for the same lead
- ✗Share the lead with unlicensed third parties
6. Connection and after-sale conduct
If a seller selects your valuation and chooses to connect, their full contact details are shared with you.
You must respect the seller's privacy and communication preferences. Do not harass, pressure, or contact them outside the agreed terms.
Once connected, your relationship with the seller is independent of ValuQ. ValuQ is not responsible for disputes or conduct after connection.
You must not discriminate against sellers or breach FCA consumer regulations in your dealings with them.
7. Prohibited conduct
You must not:
- ✗Submit false or misleading valuations
- ✗Manipulate valuations to appear more competitive
- ✗Contact sellers before they choose to connect
- ✗Attempt to move conversations off-platform to avoid ValuQ rules
- ✗Harass, threaten, or abuse sellers or other agents
- ✗Reverse engineer or attempt to extract data from the Platform
- ✗Use automated tools to scrape leads or data
- ✗Violate any UK law or regulation
- ✗Engage in anti-competitive or unfair practices
- ✗Share login credentials or allow unauthorized access
- ✗Attempt to undermine ValuQ's operations or reputation
Violation of these rules will result in immediate suspension or termination.
8. Pricing and valuation accuracy
You are responsible for the accuracy and professionalism of your valuations. ValuQ displays your fees, services, and reasoning alongside other agents for comparison.
If a seller disputes the accuracy of your valuation, you must respond professionally. ValuQ does not adjudicate valuation disputes but may suspend your account if complaints are consistent and substantive.
You must disclose all fees in your valuation. Any additional fees imposed after connection may be subject to consumer complaints.
9. Suspension and termination
Immediate suspension without notice:
We may suspend your account immediately if you engage in fraud, violate regulations, contact sellers improperly, or pose a risk to users.
Suspension means you cannot receive new leads or access the Platform.
You will have 5 business days to appeal. We will review your case and inform you of the outcome.
Termination is permanent. Upon termination, your access ends, and any outstanding balance remains due.
10. Data and analytics
ValuQ provides you analytics on your response rates, valuation accuracy, seller engagement, and area benchmarks.
You may not share or redistribute this data without permission. This data is for your internal business use only.
ValuQ may use aggregated, anonymized data to improve the Platform and publish market insights.
11. API and integrations (Pro plan only)
Pro plan subscribers have access to REST API and webhooks for integration with your CRM or internal systems.
You must:
- •Keep API keys secure and confidential
- •Not exceed rate limits
- •Not use the API for unauthorized purposes
- •Comply with API documentation and terms
ValuQ may revoke API access if you misuse it.
12. Liability limitations
ValuQ is provided "as is" without warranty. We do not guarantee:
- •Uninterrupted access to the Platform
- •Quality or quantity of leads
- •Seller conversion or instruction rate
- •Accuracy of seller contact information
To the maximum extent permitted by law, ValuQ Ltd is not liable for:
- •Loss of profit, revenue, or business opportunity
- •Indirect, incidental, or consequential damages
- •Data loss or breach of service
- •Any reliance on data or analytics provided
Our total liability shall not exceed the fees you paid in the 12 months prior to the incident.
13. Intellectual property
All Platform content, design, algorithms, and software are owned by ValuQ. You may not copy, reverse engineer, or redistribute them.
Your valuations and content remain your property. By submitting them, you grant ValuQ a worldwide license to display and aggregate them.
14. Confidentiality
You must treat all seller information as confidential. You may not disclose it to third parties without explicit consent or legal obligation.
15. Dispute resolution and complaints
If you have a complaint about ValuQ, contact us at agents@valuq.co.uk. We will respond within 5 business days.
We will attempt to resolve disputes informally. If unresolved after 30 days, either party may pursue legal action in UK courts.
Disputes with sellers you connect with are independent of these Terms. ValuQ does not intervene in disputes between agents and sellers.
16. Amendments
We may update these Terms at any time. Material changes will be notified 30 days in advance by email. Continued use constitutes acceptance.
17. Governing law
These Terms are governed by the laws of England and Wales. Both parties submit to the exclusive jurisdiction of English courts.
